1. Acceptance of Terms
By accessing and using Starboard ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Starboard is a digital platform that allows users to create, manage, and share vision boards for personal development and manifestation. The service includes tools for creating visual representations of goals, affirmations, and personal aspirations.
3. User Accounts
Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms of Service.
4. User Content
Content Ownership
You retain ownership of all content you create, upload, or share on the Service, including vision boards, images, audio, and text. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.
Content Responsibility
You are solely responsible for the content you create and share. You agree not to upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable, or that infringes the copyright, trademark, or other intellectual property rights of any third party.
Content Removal
We reserve the right to remove any content that violates these Terms of Service or applicable laws, without prior notice.
5. Copyright Policy (DMCA)
Starboard responds to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA," 17 U.S.C. § 512). For the full notice and counter-notice procedure, the required contents of a DMCA notice, and our repeat-infringer policy, see our DMCA Policy.
Designated Agent. DMCA notices may be sent by email to captain@starboardmanifest.com (subject line "DMCA Notice"), or by post to Starboard Manifest, {{MAILING_ADDRESS}}. Misrepresentation in a DMCA notice or counter-notice can result in liability under 17 U.S.C. § 512(f).
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms of Service. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any international, federal, state, or local laws
- Infringe upon or violate our intellectual property rights or the intellectual property rights of others
- Harass, abuse, insult, harm, defame, or discriminate
- Submit false or misleading information
- Upload viruses or other malicious code
- Spam or send unsolicited communications
- Interfere with or disrupt the Service or servers
7. Intellectual Property
Our Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Starboard and its licensors. The Service is protected by copyright, trademark, and other laws.
Trademarks
Starboard and related graphics, logos, and service names are trademarks of Starboard and may not be used without our prior written consent.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.
9. Paid Services and Subscriptions
9.1 Subscription Plans
Starboard offers Monthly, Annual, and Lifetime memberships. Monthly and Annual memberships are auto-renewing subscriptions: at the end of each billing period, your payment method will be charged for the next period at the then-current price for your plan unless you cancel at least 24 hours before the current period ends. Lifetime memberships are a one-time payment and do not renew.
9.2 Billing Account and Cancellation
Where you signed up determines where you are billed and how you manage your subscription:
- Apple App Store (iOS): Payment is charged to your Apple ID account at confirmation of purchase. Manage or cancel at any time at apps.apple.com/account/subscriptions.
- Google Play (Android): Payment is charged to your Google Play account at confirmation of purchase. Manage or cancel at play.google.com/store/account/subscriptions.
- Web (starboardmanifest.com): Payment is processed by Stripe. Manage or cancel from Account → Billing → Manage billing.
Cancellation takes effect at the end of the current billing period; you retain access until then. Turning off auto-renew is equivalent to cancelling for the purposes of these Terms.
9.3 Free Trials
If we offer a free trial, you will not be charged during the trial period. Unless you cancel before the trial ends, you will be automatically charged the subscription fee at the end of the trial.
9.4 Refunds
- App Store and Google Play purchases are governed by the refund policies of Apple and Google, respectively. Refund requests must be made through those storefronts.
- For web purchases processed through Stripe, we do not offer refunds for partially used billing periods except where required by law.
- California residents: if you have not used the Service during the current paid period, you may request a refund by emailing captain@starboardmanifest.comwithin seven (7) business days of purchase, in accordance with Cal. Bus. & Prof. Code § 17602.
- EEA / UK residents: you may have a statutory right to withdraw within 14 days of a web purchase under the EU Consumer Rights Directive (2011/83/EU) and equivalent UK law. By starting to use a digital subscription before the 14-day period has ended, you expressly consent to immediate performance and acknowledge that this may waive your right of withdrawal under Article 16(m).
9.5 Price Changes
We may change subscription prices from time to time. We will provide at least 30 days' notice before a new price takes effect. If you do not cancel before the new price takes effect, your subscription will renew at the new price.
9.6 Taxes
Prices shown may not include applicable taxes. Where required, tax is added at checkout.
9.7 Payment Processing
Payment processing is handled by Stripe (web), Apple (iOS), and Google (Android). We do not store your card or bank details on our servers.
10. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.
11. Limitation of Liability
In no event shall Starboard, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
12. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
13. Changes to Terms of Service
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
